BY ACCEPTING THIS POLICY, YOU AGREE TO BE BOUND BY THE ARBITRATION PROVISION AND CLASS ACTION WAIVER CONTAINED IN THOSE SECTIONS. PLEASE READ IT CAREFULLY.

OVERVIEW

We are Inhale H2 Ltd (along with our subsidiaries, “Inhale H2”, “we”, “us”, or “our”) and we operate websites and other services under the brand name “Inhale H2” and any brands we develop in the future. This Shipping Policy (“Policy”) applies to all purchases made through www.zydrogenai.com (the “Website”) and should be read together with our Terms of Sale, Returns & Refunds Policy and Privacy Policy (collectively, the “Agreements”). 

Binding Effect and Hierarchy of Terms.

This Policy is incorporated into and forms part of Inhale H2 Ltd’s Terms of Sale, which govern all purchases made through our website. In the event of any conflict between this Policy and the Terms of Sale, the Terms of Sale shall control. All provisions concerning limitation of liability, indemnification, mandatory arbitration, class-action waiver, and governing law contained in the Terms of Sale apply to this Policy and are incorporated herein by reference as if fully set forth. Please review these documents prior to using the Services. To the extent allowed by applicable law, by using the Services, you agree to this Policy and our handling of your information as set forth in our Privacy Policy, as well as the terms outlined in our Terms of Sale and Returns & Refunds Policy. If you don’t agree with this Policy, don’t want us to handle your information as set forth in our Privacy Policy, or do not agree with our Terms of Sale or Returns & Refunds Policy, please don’t use the Services or visit the Website.

All references to “you” or “your,” as applicable, mean the person who accesses or uses the Services in any manner, and each of your heirs, assigns, and successors. If you use the Services on behalf of an entity, organization, or company, you represent and warrant that you have the authority to bind that entity to this Policy, your acceptance of the Policy will be deemed an acceptance by that entity, and “you” and “your” herein shall refer to that entity.

We reserve the right to change or update this Policy from time to time at our sole discretion. Except for changes to the Arbitration section, we reserve the right, at our discretion, to change, modify, add, or remove portions of this Policy any time by posting the amended Policy here with an updated “Last Updated” date above. Please review the Policy frequently for any changes. If the changes include material changes that affect your rights or obligations, we will notify you of the changes by reasonable means, which could include notification through the Services or via email. Your continued use of the Services following the effective date of any changes to this Policy constitutes acceptance of those changes. If you do not agree to the new Policy, you may not use the Services.

  1. GENERAL CONDITIONS

We reserve the right to refuse to provide the Services to anyone for any reason at any time. We may change, add, or remove features, products, or functionalities, or we may also suspend or stop the Services altogether. We may take any of these actions at any time for any reason, with or without notice. We are not liable to you or to any third party for any modification, suspension, or discontinuance of the Services.

The Services, including the Website and any related Apps, are not intended for children, and you must be at least 18 years old to use the Services. By agreeing to this Policy, you represent and warrant that (a) you are over 18 years old and at least the age of majority in your state or province of residence, or (b) you are the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services.

You represent and warrant that you have all necessary rights, power, and authority to agree to this Policy and perform your obligations hereunder, and nothing contained in this Policy or in the performance of such obligations will place you in breach of any other contract or obligation.

  1. PROCESSING TIMES

2.1 Orders are typically processed within three (3) business days, subject to inventory availability.

2.2 Orders begin processing once payment is received and verified.

2.3 Processing times may be extended during high-volume periods, promotional events, or holidays.

  1. SHIPPING METHODS AND TIMEFRAMES

3.1 Standard and expedited shipping options are available at checkout.

3.2 Estimated delivery times (excluding processing): (a) Standard – United States & Canada: 3–7 business days from shipment; (b) Expedited – United States & Canada: 2–3 business days from shipment.

3.3 Delivery times are estimates only and not guaranteed. Delays may occur due to carrier capacity, customs clearance, or events outside our control.

  1. SHIPPING LOCATIONS AND RESTRICTIONS

4.1 We ship from fulfillment facilities in the United States and Canada.

4.2 We do not ship to P.O. Boxes, APO/FPO addresses, or jurisdictions where shipment of our products is restricted.

4.3 Carriers generally do not deliver on weekends or federal holidays.

  1. SHIPPING COSTS

5.1 Shipping charges are calculated at checkout and vary based on product weight and destination.

5.2 Promotional free shipping offers may be available from time to time and are subject to conditions specified in the promotion.

  1. RISK OF LOSS AND TITLE

6.1 Title and risk of loss pass to you when the products are transferred to the carrier, except where mandatory consumer law requires delivery before risk passes.

6.2 We are not liable for lost, delayed, or stolen shipments once products are in the carrier’s possession.

  1. CLAIMS FOR DAMAGED OR INCORRECT GOODS

7.1 Damaged goods or incorrect shipments must be reported within five (5) business days of receipt to support@zydrogenai.com.

7.2 To process a claim, you must provide: (a) order number; (b) photographs of the damaged goods; (c) shipping boxes and labels; and (d) manufacturing codes located on the product packaging.

7.3 We will make every effort to remedy claims promptly by offering replacement, store credit, or refund, at our discretion.

  1. RETURNS AUTHORIZATION (RMA)

8.1 Once an order has been processed, it cannot be canceled or rerouted.

8.2 If you wish to return an item, you must contact support@zydrogenai.com to obtain a Return Merchandise Authorization (RMA).

8.3 An RMA is required for every return. Items returned without an RMA will not be accepted.

8.4 We are not responsible for shipments rejected without an RMA.

  1. SUBSCRIPTION SHIPMENTS

9.1 Subscription orders are processed automatically based on the schedule selected at purchase.

9.2 To cancel a recurring subscription shipment, you must contact support@zydrogenai.com at least two (2) business days before the scheduled shipment date.

9.3 Once processing has begun, subscription shipments cannot be canceled, and no returns or refunds will be accepted for such shipments.

  1. DUTIES, TAXES, AND CUSTOMS

10.1 International shipments may be subject to customs duties, VAT, GST, or other import charges imposed by the destination country.

10.2 If we offer Delivered Duty Paid (DDP), such amounts are collected at checkout.

10.3 If shipped Delivered at Place (DAP), you are responsible for paying duties and taxes upon delivery.

10.4 For EU orders valued under €150, VAT may be collected at checkout under the Import One Stop Shop (IOSS) system where indicated.

  1. DELIVERY ISSUES

11.1 If an order is not received within the estimated delivery period, you must notify us within thirty (30) days of the shipment date.

11.2 We may, at our discretion, issue a replacement, store credit, or refund once delivery issues are verified.

  1. INTERNATIONAL CONSUMER RIGHTS

12.1 European Union and United Kingdom. Delivery obligations are subject to mandatory consumer rights. You may cancel an order within fourteen (14) days of receipt under our Returns & Refunds Policy.

12.2 Australia. Deliveries are subject to the Australian Consumer Law, which provides non-excludable guarantees.

12.3 Canada and Québec. Provincial consumer protection laws may impose delivery obligations. Québec’s Consumer Protection Act governs in the event of conflict with this Policy.

  1. ENTIRE AGREEMENT

This Policy forms part of the overall contractual framework between you and Inhale H2 Ltd, together with our Terms of Sale, Returns & Refunds Policy and Privacy Policy. All referenced documents are intended to be read together, and the provisions regarding limitation of liability, indemnification, arbitration, and class-action waiver in the Terms of Sale apply to all of them.
